Written buyer agreements before tours: an intake workflow

Since August 17, 2024, agents need a written agreement with a buyer before touring a home. Building it into intake keeps tours on schedule and records complete.
What changed
Under the practice changes from the NAR settlement, MLS participants working with buyers must enter a written agreement with the buyer before touring a home, whether in person or by live virtual tour. The agreement must state the compensation the agent will receive.
Where it goes wrong
- Each agent handles the form differently, so records are uneven.
- Buyers see the agreement for the first time at the door and want time to read it.
- Tours are booked before anyone checks that the agreement is signed.
An intake workflow that works
- Explain the agreement in plain language in the first reply to a new buyer.
- Send the agreement for e-signature as part of booking the first tour.
- Have the scheduling tool check for a signed agreement before confirming a tour.
- Store signed agreements in one place the broker can review.
- Remind the agent when an agreement is near its end date.
Check with your broker and forms
Use the buyer agreement forms your brokerage and local association require. The workflow should deliver and track those forms, not replace them.

A brokerage must get a written buyer agreement before every tour, and agents handle it differently. The fix is one intake flow with e-signature before scheduling, and advertising that meets TREC rules.
